My standard reply may become the following verbiage.

If a movies status is reasonably questionable, upload it and see if the Copyright holder asks for it to be removed. Anyone other than the current holder is making an educated guess at best. Even the most knowledgeable person on this site has admitted to an error about PD status at some point.
The Internet Archive people quickly remove those files that are uploaded in good faith but which are later found to be copyrighted.
Just don’t make it hard on the staff by posting obviously copyrighted materials.
And send a donation in.

Of course the uploader should have an understanding that the Archive's safe harbor does not extend to them and that even unintential, non-commercial, or unknowing infringement of copyright may leave them liable to civil or criminal penalties. Even after the Archive takes the item down.
